Terms of Service

These Terms of Service (“Terms”) govern access to and use of the DiscoCraft website and platform (the “Service”), operated by DiscoCraft (“DiscoCraft,” “we,” “us”). By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

DiscoCraft is a discovery and lead-generation platform that connects licensed bars and restaurants (“Bars”) and individual consumers (“Individuals”) with independent craft spirits producers and brands (“Brands”). DiscoCraft helps Bars and Individuals discover products and submit requests to Brands, and helps Brands manage and respond to that interest.

DiscoCraft is not a retailer, wholesaler, distributor, or importer of alcoholic beverages. We do not sell, resell, take title to, warehouse, ship, or deliver any alcoholic beverage product, and we are not a party to any sale or purchase that may occur between a Bar or Individual and a Brand. Any such transaction is solely between the requester and the Brand, is subject to their own legal, licensing, and regulatory obligations (including applicable state alcohol-beverage-control and three-tier distribution laws), and is not facilitated, brokered, or guaranteed by DiscoCraft.

You must be at least 21 years of age to use the Service. By using the Service, you represent that you are 21 or older.

If you register a Bar account, you represent that you are an authorized representative of a business that holds, or is in the process of obtaining, all licenses and permits required by your jurisdiction to purchase, receive, and serve alcoholic beverages, and that the information you provide (including any liquor license or seller’s permit number) is accurate.

If you register a Brand account, you represent that you are an authorized representative of the producer or brand you list, and that you have the legal right to market and offer the products you list on the Service.

If you register an Individual account, you represent that the information you provide, including your date of birth, is accurate, and that you are legally permitted to purchase and consume alcoholic beverages in your state of residence.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current information and to keep it up to date. We may disable or terminate an account that violates these Terms, provides inaccurate information, or is used for fraudulent, abusive, or unlawful conduct.

A “request” submitted through the Service is an expression of interest by a Bar or Individual in a Brand’s product, forwarded to the Brand for response. Submitting or receiving a request does not create any obligation to buy, sell, deliver, or pay for any product. Pricing, order terms, delivery, payment, and fulfillment — if they occur at all — are negotiated and carried out directly between the requester and the Brand, entirely outside the Service, and DiscoCraft has no responsibility for the accuracy of any pricing information, the availability of any product, or the performance of either party.

Brands are responsible for the accuracy and legality of the product information, images, and other content they submit, and represent that they have the rights necessary to post it. DiscoCraft retains a license to display submitted content on the Service for the purpose of operating the platform. The DiscoCraft name, logo, and site design are the property of DiscoCraft and may not be used without permission.

You agree not to: misrepresent your identity, business, or licensure; use the Service to solicit or advertise sales in a manner that violates applicable alcohol-beverage law; scrape or harvest data from the Service outside normal use; interfere with or disrupt the Service; or use the Service for any unlawful purpose.

The Service is provided “as is” without warranties of any kind, express or implied. DiscoCraft does not verify every claim made by a Bar or Brand and does not guarantee the availability, quality, or legality of any product listed, or that any request will receive a response.

To the maximum extent permitted by law, DiscoCraft will not be liable for any indirect, incidental, special, or consequential damages, or for any transaction or dispute between a Bar and a Brand, arising out of or relating to use of the Service.

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
